Under section 364 of the Workplace Injury Management and Workers Compensation Act 1998, the Minister may from time to time by order make Rules of the Commission concerning any aspect of procedures to be followed in connection with the jurisdiction or functions of the Commission. The current Workers Compensation Commission Rules 2011, cover a range of issues, including matters of practice and procedure in proceedings before the Commission and the manner of presenting documents and information by the parties.
Rule 18.1 of the Workers Compensation Commission Rules 2011 states that the President, in consultation with the Deputy Presidents, may issue Practice Directions in relation to the operation of the rules, and may from time to time rescind or amend any such Practice Direction. A range of Practice Directions have been issued providing guidance on many different types of applications and processes managed in the Commission.
From time to time the Commission publishes Guidelines, clarifying aspects of practice and procedure or dispute resolution processes not otherwise covered in the Rules or Practice Directions.
